Police catch penny-pincher enjoying a dip in new pond

POLICE have swooped on a man picking up coins from the pond in St Andrew Square – and charged him with theft.
Officers were alerted by an office worker who spotted the man dipping into the water feature, which is part of the £2.6 million revamp of the newly opened garden. Police said today a 34-year-old man had been cautioned and charged for "theft by lifting".

Although the coins have been thrown away for luck, they are collected and given to charity and stealing them is said to be technically illegal.

The charge comes after the Evening News reported this week how signs are to be erected warning people not to throw money into the water, just weeks after the garden opened to the public for the first time in 238 years.

Ian Broadfoot, of the Edinburgh City Centre Management Company, praised the office worker who called the police and asked other members of the public to do the same.

He said: "We were informed by Lothian and Borders Police that there had been an incident in the garden on Tuesday afternoon concerning the alleged removal of coins from the water feature.

"The police responded to a telephone call from a concerned office worker who had read the article regarding the garden in Monday's Evening News. I would like to thank the vigilant office worker for contacting the police. I would like to encourage other workers or visitors to the garden to report any further incidents to the police."

He added: "To help us to ensure that this ceases to happen we would urge visitors to the garden to keep their money in their pockets or purses.

"The newly opened garden is a tranquil and beautiful location that has been designed for all to enjoy and we are confident that the action of these few individuals will not have an adverse affect on this city centre oasis."

A police spokesman said a report would be sent to the procurator fiscal in connection with the incident, which took place at about 4.20pm.

The reopening of the garden was hailed as a great step forward in rejuvenating the city centre.

As well as the so-called reflecting pool, the park boasts new lighting, a cafe and a new pathway linking department stores Harvey Nichols and Jenners.

City centre councillor Joanna Mowat branded those stealing from the pool as "neds".

She said: "My overriding concern is that we're going to have to have signage put up which is going to detract from the vistas.

"I would suspect it's not homeless people doing this. I would hope there would be a little bit of discretion shown by the police if that was the case."

Designed by renowned architect James Craig, the garden was an integral part of his New Town masterplan.

Traditionally, it was open only to a select group of local residents and businesses, which have included philosopher David Hume, who lived at No 8, and politician and inventor Henry Brougham, who lived at No 21.

The pond is not the first high-profile water feature to be blighted by opportunists.

In 2003, Italian police arrested a woman stealing coins tossed for luck into Rome's famous Trevi Fountain. Another man was reported to have taken up to 1000 euros a day from the tourist attraction.

2 people mugged in the meadows, 1 female stabbed, endless stories about assaults and things.....

so the police charge someone from knocking a few coins......good to know where the priorities lie eh?????

Quite right charging this guy. They should be dealing with all crime. I would like to think the police are actively dealing with the mugging and knife incidents as well. Stop the petty crime escalating.

Good I look forward to similar proactive policing at the rest of the city parks and gardens.

Once again the EEN are using the £2.6m figure when the real costs was £5m, why are they not including the cost of renting the gardens?

Yes its a waste of police time, yes its a trivial matter but what are the police meant to do when called to such an incident and catch the perpatrator "wet handed".....

Let him go? Aye that would have youse all a ppluading the police as well.

The money was not his in the first place and therefore it is technically stealing, this is why the council or owner of the water feature collects the coins in and dontes them to a charitable cause and they can only do this every so often as the "owner" of the coin(s) has a certain amount of time in which to reclaim them anyway.

The person involved should be arrested and charged and punished accordingly and in line with his previous criminal record (i.e a caution would be likely had he had no previous convictions).

Are we just to allow people to commit trivial acts of crime and let them go totally unpunished because there are more serious offences which havent yet resulted in a conviction? Thought not.

Grow up some of you & give the police a break.... The guy has been charged with commiting a crime and the court system will now decide on the appropriate punishment. Thts how policing works from "harvesting coins in a fountain" at one end of the scale to murder at the other.

Who was he stealing from? He was stealing for charity. It's right there in the article.

So now we have the police telling us that we shouldn't give to charity by throwing coins in the pond. That's quite simply surrender to the criminals.

The police should recognise an opportunity when they see it. This is the chance to catch criminals stealing before they burgle houses or mug pregnant women. Time to get out of the patrol car and do their jobs.

As for everyone else: keep throwing coins in the pond. Not only will it go to charity, it migh get some criminal scum banged up along the way.

Me and my mates were in the St Andrew Square gardens the other day with our pit-bulls so that they could get a bit of exercise and do the toilet.

One of my mates took out over £5.00 worth of coins and nobody said "boo" to us. Mind you, our rabid, wild pit-bulls would just tear the suit off any sappy office worker.

It is going to be great spending lazy days in the gardens during the summer. Collecting coins helps towards our cheap carry-out from Sainsbury's across the road.

The police were right to arrest the person responsible, hopefully it will send out a message to other jakies that theft won't be tolerated. Although the good councilllor would let them off with a slap on the wrist and good talking to.

There does not need to be a complainer when it comes to theft...if you find an item, not neccessarily expensive, and keep it, you can be charged with 'Theft by finding'....never heard of 'Theft by lifting' though....

I say let them throw money into the pond, maybe if enough is thrown in we won't have to pay extra taxes to offset the increasing cost of the tram.

Theft is theft. Period. The money wasn't his, so he was stealing it. No one said he could have it. And...the money was being used for charity, now they've stopped it. A loss to charity.
Can't some people realize that if the theft was from them personally they'd be screaming their heads off, but if from someone else it isn't a theft????
I applaude the office worker who called police. Crime watch is a good thing. We have neighborhood crime watch here. Good for that office worker!
