NAKED Rambler Stephen Gough has cost the taxpayer more than £100,000 due to his refusal to wear clothes, his lawyer said today.
Most of the bill is believed to have been run up keeping the 47-year-old in the segregation wing at Saughton Prison for much of the past 18 months.

Costs from legal aid have also boosted the total, along with expenses incurred by police and secur
ity firm Reliance.

And his latest appeal case against a contempt of court charge was heard by five of Scotland's top judges. Gough's lawyer John Good today blamed the spiralling costs on a "Mexican stand-off" between his client and the authorities, in which "neither is willing to blink first".

The former Royal Marine has been arrested nine times since September 2005 and been convicted of seven counts of breach of the peace. He has also been hit with contempt of court orders on four occasions. His most recent arrest came on Thursday when he was found naked in the Grassmarket just minutes after being acquitted on an earlier charge at Edinburgh Sheriff Court.

Mr Good, who has represented Gough for the last eight months, said: "It costs thousands of pounds a week to keep someone in segregation and Stephen has been there for about 13 months.

"He's already had four hearings at the Appeal Court in front of judges and eight more pending."

The Scottish Legal Aid Board confirmed Gough has received more than £3000 in assistance so far, with further bills for a similar amount due to be paid.

Mr Good said he had received a total of around £1800 for defending his client. He added: "No lawyer is going to make a fortune from Stephen Gough."

But politicians said that the public had to be protected from offence. SNP justice spokesman Kenny MacAskill said:

"If he ventures into an area where there are children, officers would be failing in their duty not to take action."

Independent Lothians MSP Margo MacDonald said: "I would like to be assured whether he's being willful or maybe he has psychiatric issues to put himself through such discomfort in jail."

And Tory justice spokeswoman Margaret Mitchell said: "I think we have to look at whether legal aid should be given in such cases."

Lothian and Borders Police first arrested Gough in August 2003 walking naked on the Forth Road Bridge. In September 2005, he was arrested on the A701 on his second naked national walk.

Five of his arrests have taken place in the car park of Saughton jail upon release, while he was also charged with stripping off on a plane from Southampton to Edinburgh last year.

A Scottish Prison Service spokesman confirmed Gough was currently on remand in Saughton awaiting trial. Jail bosses said they had no power to ensure he left their custody clothed after completing his sentence.

A police spokeswoman said: "Mr Gough has committed a number of criminal offences by wearing no clothes in public and Lothian and Borders Police have a duty to charge him and let the courts deal with the issue."

webcam off!!! 18/04/2007 13:45:04

Which is the most idiotic, Gough or the legal system? He has made his point about public nudity and should simply be sent home, not left languishing at the taxpayers expense.

If Scotland were independant, we could deport him!

If he want's to go naked in the great outdoors/in front of others, then there are plenty options open to him such as naturist resorts and clubs, nudist beaches, and even fetish clubs.

Floating about stark bollock naked in the Grassmarket in not, and never will be, one of those options.

The Naked Heckler,

what harm is the guy doing? if he wants to walk around naked then just let him - he's not harming anyone and if children see him then so what, he's naked not behaving in a sexually deviant manner.

I'd much rather see the police and courts stop wasting their time on a man who wants to walk about in the buff and start to concentrate on real criminals such as the rapists, muggers and thieves who are a real danger to other people!

We do not paritcularly condone Seve's actions but equally we are astonished by the unthinking response of the legal system and some members of the public.

I will answer a few of the points:

In Scotland there are not "plenty of options". There are only two clothes optional beaches, both in very difficult to reach areas, and a handful of clubs. Some English counties have better provision than that. The prejudice and provision in Scotland is woeful.

The suggestion that there is some connection between naturism and fetishism is insulting.

Kenny MacAskill said "If he ventures into an area where there are children, officers would be failing in their duty not to take action." People have repeated that sort of statement so often that they have come to believe it. I defy Mr MacAskill to produce any evidence that non-threatening, non-sexual nudity can do harm to a child. Conversely there is plenty of evidence that prudery does do harm. His statement is an insult to naturists in general and naturist families in particular.

Antipathy to nudity is entirely a taught reaction and younger children are oblivious to it unless an adult makes a fuss about it. Teenagers may be embarassed or amused but that is not a reason to gaol somebody.

This whole saga has a lot more to do with adult preconceptions and prejudices than it does with protecting children.

This character is either unable or unwilling to understand why what he does is wrong. If it is the former he needs to be incracerated in a mental institution, if it is the latter he needs to be incracerated in a prison preferably for a very long time, he is a serial sex offender.

13

Give him a 20 year suspended, if he breaks the law again he'll know whats coming. He's not a protester he's just a nob who's parents never really loved him enough and he's looking for attention.

Theres a naked guy in Sachsenhausen, Frankfurt who just goes about his daily business. It's no big deal. Stiff upper LIP and all that British Jazz, just leave the guy alone.

Frostbite will get him in the end.

19

Hmmmm,

Glasgow 18/04/2007 15:34:09

Right or wrong, he has broken the law and has to be dealt with by the courts. If there is a case for changing the law then it should be made through the proper routes.

Oh, and take him out of segregation and see how many times he re-offends.

20

Grouchy,

Edinburgh 18/04/2007 15:35:39

I agree with Nuke Boy although I don't think he needs to be taken as far away as the west coast. The man is obviously an exhibitionist and should be taken to some where isolated preferably on a really cold night or when the thistles are in full bloom and left to wander.

21

Just passing through,

18/04/2007 15:37:12

He is obviously mentally disturbed and should be sectioned.

22

23

One-man-bucket's older twin,

18/04/2007 15:44:32

I find the British antipathy to nudity baffling - except perhaps on aesthetic grounds. The average Brit is best seen with its kit on, preferably in a darkened room.

To accuse him of sex crime is insane - we've all seen advertising posters with more sexual implications than an adult male wandering around in the buff.

And in this climate, hasn't the poor guy suffered enough? Good luck to him.

24

Leave the poor chap alone! If his nudity offends you, simply look the other way. Kenny McGaskill is a 'rent a comment' politician who'll say anything likely to win a vote or two. It's our self serving MSP's who need to be exposed!!

31

Malcolm Boura,

UK 18/04/2007 16:07:16

Unlike probably all of the other people commenting here I have actually met him although only briefly. He is a quietly spoken, unassuming pleasant bloke and he is not an exhibitionist. He just prefers to dress in a rational way, boots and a rucksack for hiking, and he refuses to let anyone bully him into following an arbitrary dress code.

It is also doubtful that he has actually broken any law, at least on any evidence based and objective reading of what the law actually says. Far too many people, including police and courts, just assume that nudity must be an offense and that any likely sounding bit of law applies. There is nothing in either English or Scots law that explicitly makes nudity an offense so they resort to vague catch all offenses which are wide open to interpretation to suit the prejudices of the enforcer.

35

Cynicaltalk,

E Lothian 18/04/2007 16:33:44

Is the guy actually doing anyone any harm?

This country is a joke. We mollycoddle paedophile's and drug dealers and whinge about the 'human right' violation's of rapists who are forced to slop out.

And then call for the scrapping of legal aid for a guy who just wants to walk around in the buff.

And as for Kenny MacAskill, if the police have a duty to protect children when he walks naked in an area where they congregate, then why the hell will they not support a Sarah's law and give parents a right to protect their children when the 'right on' weak authourities house a paedophile next to a primary school?

36

40

neilfent,

So many people want to see the end of all this. Very easily achieved if they and the police would just leave him alone. He would surely be on his way as soon as he could! God gave us naked bodies. It is we (well not me) who insist on hiding it away in shame and thinking others should do likewise. A naked body is not shameful or sinful. What one does with it may be. On a naturist beach the girl that gets gawped at is the one walking past in a sexually titivating skimpy bikini not the innocent naked family quietly sunbathing or swimming.

41

They could always just not arrest him, then it wouldn't cost a penny.
As for the excuse that his nudity might 'offend children' --- rubbish, they'd just ignore him or laugh, children are not 'offended' by nudity until self-opinionated people teach them to be.
Let's face it, the powers that be just don't know what to do with him, it's laughable.

51

JuanKerr,

Stick him in population. Will soon sort out his ideas into rational reasonable ones when the folk tell him to get tae ..... Totaly another toff with a rejection complex.

To draw a comparison. Would I be allowed to put a poster out saying a particular group must be evenged? It does no harm? Only the people viewing it could potentialy do harm. Can I have a gun ? It does no harm. The list goes on.

He does no harm.Tell that to some 6 year old thats been slapped in the face by his saggy old plums! and left with the scars! or witnessed his unwipped clingons or had to share a seat on the bus after him.

What about a woman who has been raped by a deviant. And he strolls towards her? Does no harm? or is it her fault for narrow mindedness.

54

I have actually seen this guy walking along the road and no it wasn't me who called the police! I and many others got the impression he was enjoying all the attention he was receiving.

Personally I can't honestly see this guy living totally in the nude in Scotland over the winter months.

#11 & 31
You may think it's okay for him to walk around nude and to be quite honest with you it doesn't bother me as he's got nothing Ive not seen before and it was nothing startling anyway!

BUT I would not like my young grandaughter to see that and that is MY right to protect my grandaughter.

Hey Naked Rambler! If you read this, get it through you thick skull. Going naked in public is a crime!!! The only "legal" place to be like that, is at Nudist resorts, Nudist beaches.

In downtown, Edinburgh, or anywhere, other than thoes places is illegal! Constently doing this is only tieing up the legal system and the Police, for something trivial.

By the way. Do you like all this attention you are getting, hmm?

(59) David Cavers is typical of many individuals in Canada who think nakedness is disgusting and must be criminalized..but note he cannot bring himself to say why!!

We even had a movement in Canada a few years back pushing for Boxer dogs and others with prominent genitalia to be clothed for fear it might send some of our gentler kin into a sexual frenzy...similar I suppose to the sexual excitement 'decent' Victorian era gentlemen felt on seeing even the slightest bit of an uncovered ankle!!

He is being prosecuted for a breach of the peace. Who's peace is he breaching, who is the complainers? Upsetting the leiges? Has any member of the public complained re this mans actions? Or is it the Procurator Fiscal and the Police who are adamant in bringing this man to Justice?
If he isn't being lewd and there is no indecent behaviour why not leave this man to continue in his way. Better than £100,000 legal costs what a waste of money and that doesn't include police time. Funny they are there to deal with this man, try and get one in a hurry elsewhere!

I cannot believe that some people think its okay to walk about with all their family jewels hanging out, Im not a prude in any way but I do think that its uncalled for to have to witness this ........
I have neices and nephews that are getting brought up with morals and this man obviously has none ..... Yes I would report him if i saw him, That is my right to do so and would I be offended by his manhood swinging about, well yes i would......But all these people who say leave him alone and let him get on with it....would you honestly want him walking along the street talking to your 14 or 15 year old daughter or would you be happy with him watching your toddler son/daugher somehow I do not think so...He is out to get all the publicity he can and he has ...Im not saying he is a sex offender but he is as close to a flasher only difference being hes not aroused when walking around....Just for the record as well not all flashers are aroused when they do flash/expose themselfs......He has SERIOUS problems that have to be addressed .....He is a very sad individual. Police have my backing on this one !!!

I have read all the attached comments as well as the article regarding your "nude problem". I must say, as a Scots-American and an American Naturist for lo the past 55 years I am at a loss to understand the Scot's dither about the subject. Apart from some stodgy women gawping at the man's nether region in their own puriant curiosity and keening to one another like chickens, no one really gives a damn. Sorry, there are the politicians currying favor as well. Should a lady present herself in the exact circumstances the same busybody women and low-mentality men would cluck, chuckle and point and your weans would simply go about their business because they prefer being nude as well!!!. But I strongly doubt that 100,000 pounds would be spent "chasing the dragon". Get over yourselves! Take off your own clothing and try to practice being a human animal rather than the condescending, clucking, sky-is-falling, prudish busybodies that you appear. Get Naked and Enjoy It! I do.
