Published Date: 17 April 2008
A SANDWICH shop owner has been told to clean up litter dropped by his customers – despite the fact that all the nearby bins have been removed for the tram works.
Furious David Liddle, the manager of Baguette Express on Shandwick Place, says he has been threatened with enforcement action by the city council.

He told the Evening News he was approached by litter wardens and told to clean up branded wrappers a
nd coffee cups from within 100 metres of his shop.

As part of the five months of tram work on the street, the public litter bins have been replaced with orange plastic buckets. Street cleaning patrols have also been altered.

Mr Liddle said: "I had people from environmental health round here recently telling me that we would be held responsible for every piece of litter dropped within 100 metres of my store.

"I explained to them that the tram workers had taken away all the bins, and that we don't get the same rubbish collection services that we used to.

"They pointed to the orange buckets that have been placed along the street and said the rubbish could be put in there.

"I wouldn't have even known that these were bins, and I don't expect many of my customers will have known either."

The city council can hand out street litter control notices under the Environmental Protection Act 1990. These require a business to keep the surrounding area, up to a maximum radius of 100 metres, free of related litter.

Mr Liddle added: "It's a complete joke. We've had to put up with no end of bother since these tram works came in.

"Our takings are down, we can barely hear the customers because of the racket outside, and at one point the counter was vibrating because of the heavy machinery going backwards and forwards.

"Now we're being told that we have to keep the street tidy of other people's rubbish even though there are no bins."

The council said its enforcers did not serve a litter control notice on Baguette Express, and it had so far been unable to locate the team that spoke to Mr Liddle.

However, the spokeswoman added that environment teams would be visiting Baguette Express in the next few days to discuss any outstanding concerns, and assure Mr Liddle they would be on hand to help him deal with the litter problem.

Councillor Robert Aldridge, environment leader, said: "While the tram works are under way in the city, we are keen to work with businesses affected to mitigate any issues with litter and waste disposal.

"We have altered our street cleansing regime and environmental warden patrols to accommodate the ongoing works and deal with littering in the area.

"In addition, the Edinburgh tram project currently has two logistic teams in Shandwick Place and Constitution Street to support businesses with the movement of goods and waste to and from premises."

A spokesman for tram company TIE said litter enforcement on Shandwick Place was a matter for the council.

Pretty sad that people just dump their rubbish in the streets. a wee sign might help. If those orange things arent bins, what are they ?!

Jenny MacArthur,

Yep. There's a lot of slobs around who aren't fit to live in kennels. When I see anyone dropping litter, the first thing I think is that that their mother must have been a revolting slob themselves not to bring up their kids properly.

But it's only fair that shops that profit from selling stuff in polluting packaging should pay for the costs of clear up. Why should the rest of us foot the bill for the mess they create?

Instead of persecuting the shop owners why don't the litter wardens tackle the dirty sods who drop litter in the street?

Is it not the job of environmental warden patrols to catch the litter louts?

It seems to me that a great income opportunity is being missed here.

Erm, excuse me, this is a story about trams roadworks. Would somebody please make an inane comment about how the trams are ruining the city?

Arent they doing the same to macdonalds and all the other fast food chains that have branded wrappers?
If they are theyre not doing a very good job, or are they just being vindictive against this one person?

If Baguette express are responsible for all litter near their shop, now's a cracking time for some heavy duty flytipping.

#1 - probably sick bins! Council come up with some odd ideas without taking into account the end user!

The tramways are being blamed for everything now. Wonder what all will do when and if they get finished.

I don't get it. How can the owner of a shop be held responsible for litter dropped by his customers? I just don't get it.

There must be some mistake.

The fact that the bins have been removed does not give people the right to drop litter. Why these people can't carry the litter until they find a bin elsewhere is beyond me. Cretins

Just someone else who figures we should clean up after his business.

Here's a clue: give them the sandwiches *without* a wrapper and then they can't drop any litter.
15

wolfette,

Edinburgh 17/04/2008 13:27:24
perhaps if Mr Liddle puts a sign up in his shop (a few signs even) that says "Please use the orange buckets while the normal litter bins have been removed" it might help a wee bit?

Is Edinburgh getting trams?

Lazy council trying to get businesses to do their own job. Get the environmental wardens on commission to catch the real litter louts, or is that just far too obvious?

A good start by the council, its about time these sandwich shops and takeaways were made to clear up the mess they are partly responsible for.

I hope the £24k PA litter wardens are doing their part too by handing out more fines for those that still drop litter. Fat chance of it happening though, they are either off sick or busy hiding away from the public.

no2. You want businesses to pay for "selling stuff in polluting packaging"?
You do realise if there was such an inniative for using plastics and what not then business will just make us pay for the charges by increasing costs?
The you'll start moaning about too.

#24 Phone the council and ask them how much a warden earns, while you're on ask how much they pay the guy who wheels your bin to the back of the lorry then dumps it somewhere near your house. You might want to sit down if you have a weak heart.

The whole council is a overstaffed overpaid joke.

On average each of the 32 "litter wardens" handed out 1 fine per week last year. I'm sure you'll agree they're not exactly good value for money.
31

Duncan in Edinburgh,

If the powers that be are so intent on eradicating litter I suggest they take a tour of the A720 Edinburgh By-Pass on a double-decker bus sitting in the upper deck and view for themselves trash trash trash trash all the way from the Gyle to Sheriff Hall roundabout and return.
A wonderful welcome for visitors to Scotland!!!!!

Litter wardens are on 26 grand a year to go window shopping, they are no more than a PR stunt! As for the binmen 14grand .Ive seen the binmen in my street in all weather doing there job,but as my name suggests not the litter wardens.Who do you think deserves the 26 grand?
34

Euan,

Edinburgh 17/04/2008 17:30:26
You really would think these litter wardens would have something better to do with thier time.

What a bunch of pathetic losers.

It's not as if the shop owner has any control over the way his customers dispose of their sandwich wrappers etc.

If TIE and the Council had properly informed locals and passers-by about these stupid orange 'buckets' then maybe there wouldn't be so much litter blowing about.

I would imagine there are FAR more food wrappers dropped by customers from the McDonalds than that of David Liddle's shop and I bet you they are not getting hassled by these beat-plodding, overweight, pedantic numpties.

And all this idiocy caused by an an unneeded and unwanted tram LINE...

35

Reference all the mess in Shandwick Place, could I ask a question?
As this is the narrowest, busiest bottleneck in central Edinburgh, and it would be good to dislodge some of the traffic elsewhere, WHAT ON EARTH ARE THEY DOING PUTTING TRAMS THROUGH THERE?
Temporary alternative routes have been found for the buses - why not use those routes for the trams, and help clear Shandwick Place
36

Euan,

Why not just scrap the whole tram project and spend the money on far more worthy and viable transport initiatives all over Scotland?

Sorry, far too bleeding obvious...

The bin lorries your seeing in Walter Scott Ave are actually street cleaning motors, which is totally different department. The Refuge department are based at Russell Road & Fillyside Road,so the bin lorries you saw must be ghost lorries. You must be a reporter for EEN the get it wrong all the time too!
41

AndrewS,

I thought according to most other EEN articles about the trams and handwick Place that there was no trade at the moment due to the disruption. So for some reason this sandwich shop is bucking the trend of the others.

If providers of "branded" goods are to be held responsible for their litter, then the Monks of Buckfast Abbey had better keep their heads down.

Or their hoodies up.

Thia is really good news. Keep it up. All packaging should be traceable to the vendor. 100m radius is too small.

Vendors would then have a choice of whether to charge a surcharge for their packaging or to help educate the primitives..............

45 you talk alot balls they don't pick up bins because that's the cleansing department not refuge department. One cleans the streets and other pick up your refuge. I hope i have made that clear for you .So next time you write something make sure you've got the facts right imbecile!
48

LAM,

A good starting point would have been when bins were first taken away. These Environmental police should have been instructed to advise shops especially of this type which obviously generate rubbish. Telling them of the ORANGE bins and a nice touch would have been to issue a sign for the door telling patrons where to bin rubbish. However this didn't happen would have been too logical. But as a shop owner I would have as normal practice put in place a periodic check of premises outside for rubbish... that would make for good business practice keeping your business looking clean and attractive. This is a point that seems to have eluded Mr Liddle. But overall the disgraceful attitude some Brits have towards dumping their rubbish is just unbelievable. Tossing fast food wrappers out car windows while stopped at lights is a particular one that makes my blood boil. The first thing that usually goes through my head is What are they thinking destroying this beautiful country! But then you stop as it is aparent that they simply don't think! No moral fibre or conscience.. the throw away society literally. Perhaps the government should actually do what it once was thinking about; Get habitual benefits users/ or low risk prisoners to do city clean ups... at least some of these people might then become more aware... Alas I am probably dreaming!!!
