Luke Mitchell loses murder appeal

TEENAGE killer Luke Mitchell today had his appeal against conviction for the murder of schoolgirl Jodi Jones thrown out by judges.
Mitchell, 19, was found guilty in 2005 of killing his 14-year-old girlfriend, whose mutilated body was found near her home in Dalkeith.

Lawyers for Mitchell argued he did not get a fair trial and was the victim of a miscarriage of justice.

His defence team had also argued that the trial should never have been held in Edinburgh because of the publicity that followed the murder.

But today, three senior judges at the Court of Criminal Appeal in Edinburgh ruled that his appeal against conviction should be refused.

Mitchell, 19, will now continue the life sentence he received for the killing.

Following the verdict, his mother Corinne Mitchell emerged from the High Court stoney-faced and wearing a pair of dark glasses. She said: "Luke is innocent. The fight goes on". Mrs Mitchell marched across to George IV Bridge accompanied by two female friends and pursued by TV cameras but refused to comment further.

Jodi's mother, Judy, came out from the court 15 minutes later along with family and friends. When asked about how she felt about the verdict, she said it was a "total relief" and brilliant".

Asked whether this was now the end of her fight for justice, the clearly emotional mother simply nodded.

Earlier the two mothers had sat silently on opposite sides of the courtroom while the appeal verdict was read out.

It took Scotland's top judge, Lord Justice General Lord Hamilton, who was sitting with Lords Osborne and Kingarth, just 20 minutes to dash Mitchell's hopes of freedom – though they did condemn the way police questioned the teenager in the wake of the killing as "outrageous".

During the session today, Mitchell's only reaction was the flicker of a smile towards his mum as he was led into court. Judy, Jodi's sister Janine and other members of the Jones family were sitting on the other side of the court.

Mrs Jones wiped a hand across her face in obvious relief as Lord Hamilton finished speaking.

Following the decision, the Solicitor General, Frank Mulholland QC, said: "I am pleased that the Appeal Court has today upheld Luke Mitchell's conviction for the murder of his girlfriend Jodi Jones. "As the trial judge said when Luke Mitchell was originally convicted, this was a truly evil murder and one of the most appalling crimes that any of us can remember.

"The decision of the Appeal Court will be a comfort to Jodi's family that justice has been done. Our thoughts remain with Jodi's family at this time."

Mitchell's conviction, in January 2005, followed one of the most unusual and dramatic trials ever seen in Scotland – which included a visit by jurors to the woods where Jodi was found.

Mitchell will return to court at a later date to attempt to cut the length of his minimum 20-year sentence.

The judges criticised a controversial police interview with Mitchell prior to his trial. They added that detectives were not interested in his answers to their questions but carried out an "overbearing and hostile interrogation" in a bid to make him confess.

A police spokeswoman said: "Lothian and Borders Police note the appeal decision. This was a grave crime and our thoughts are with the family at this time."

lets hope jodi's family can now have some sort of closure.mitchell should just hang himself he is a monster and doesn't deserve to have a life.and to his mother you are disgusting and like your son a monster how you can cover up for your son is unbelievable,they say blood is thicker than water but he wiped out a young girls life and destroyed a family who have had enough tragedies in life.hope the pair of you rot in hell.rest in peace jodi.

But the prosecution do take risks when they start sneaking in character evidence.
When they start trying to be clever, they put convictions at risk.

I cannot judge whether he is guilty or not - but the trial should have never been held in Edinburgh. In that respect I agree with the defence team. Guilty or not, everyone has the right to a fair trial and this was not given considering all the publicity before the trial.

Not in the news nationally, or internationally?

Don't you get it? Defence lawyers will use whatever argument available in order to defend their client. That is the nature of their task. In this context throwing out the conviction because of excessive pretrial publicity is barrel scraping.

#18 You know the one thing that the police really hate about all the cop and CSI type programs on TV these days is that they are educating the bad guys about how to cover their tracks.
This makes the task of getting solid uncontestable evidence to lock up sadistic pyschos like Mitchell so much harder.

The police found DNA but none linking him thats all i said, which is true BTW. I think they found a CSI box set in his room which means he must have done it.

There was heavy rainfall between the time of the murder and recovery of the body, hence no DNA evidence connecting Mitchell to the crime scene.

#21 CSI box set doesn't prove anything. Nor does the fact that Mitchell owned a lock knife with the victims name carved into the holster, but it certainly doesn't look good.

THe way i understood it was there was DNA evidence, but because they were in a pretty full blown relationship, then it could be explained away. If you speak to anyone who sat through the entire murder trial, apparently there is no doubt that Mitchell was responsible.

I know it's hearsay but my step dad is a driving instructor and was teaching Luke's neighbour at the time so heard a lot about it from them. Allegedly Luke's family were burning clothes in the garden the evening that she went missing!!! He did it, and I really hope that Jodi can rest in peace now - best wishes to the family.

I don't know why this evil killer's mother isn't doing prison time, in my opinion.
I have no doubt in my mind, that she tried to cover up her son's murderous crime and no one will convince me otherwise.
Everytime she opens her mouth, spouting garbage like, "Luke is innocent. The fight goes on" - it makes me sick to the stomach.

Don't really know enough about this trial to comment on that, but don't always blame the parents. He is 19, after all. Hardly under a mother's apron. But I hope with this conviction that he IS guilty because a good many innocent have gone to prison. And I cannot blame a mother wanting to stand by her child. But I can say that if it were my son, and he was proven guilty by DNA or some such I could not comment, I would be too heartbroken.

He is an evil cold calculating killer,who has never shown any remorse. He should never be released.His mother should be in jail alongside him for perjury and aiding & abetting. All he is doing is costing the tax payer money. He should never be allowed to appeal again.

The trial of Luke Mitchell made me ashamed to be a Scot and made me question the administration of justice in this country.

No evidence of any kind was brought forward against him except for irrelevant rubbish about scribbles on jotters, tattoos and bottles of urine. Previously, I had imagined that at least some evidence was required to convict someone of murder in a Scottish court. Obviously I was wrong.

For a 15 year old to repetatly stap someone and still no blood was found on him is impossible to me. He had a an hour to hide his tracks. come on. no one can do that.
