Mechanic jailed for 'vicious' attack on spaniel

A MECHANIC who kicked a dog around a beach "like a football" was jailed for three months today.
Martin McNaught, 29, of Gilmour Street, Southside, took his ex-girlfriend's Welsh springer spaniel for a walk at Silverknowes.

But, with a job interview coming up, he lost his temper when Simba refused to go back to the car and lashed out at the
dog.

He was found guilty after a trial at Edinburgh Sheriff Court last month of causing the animal unnecessary suffering on March 6 last year.

McNaught had admitted dragging the dog by its lead and giving it a "shove" with his foot, but denied kicking or stamping.

However, witnesses saw McNaught, who had a young child with him at the time, repeatedly kicking the two-and-a-half-year-old dog, standing on its head and dragging it over a wall by its lead.

Defence agent Phil Templeton said two vets had been unable to say whether or not Simba had been injured.

But Sheriff Elizabeth Jarvie QC, sentencing McNaught today, said it had been "a cowardly and vicious attack which caused the witnesses to be shocked and sickened".

Eyewitness Barbara Brewster, 47, told the trial last month that people walking along the beach were screaming at McNaught to stop his attack.

Another witness, David Waughman, 47, told the court: "I have never seen anything like it. It was like he was kicking a football."

Doreen Graham from the Scottish SPCA welcomed the three-month sentence for what she described as a "cowardly act against a small dog". The law allowed for a sentence of up to a year and or a fine of £20,000.

When the incident occurred, she said, the society had been inundated with people who had witnessed the attack.

She added: "Their descriptions are still hard to listen to".

Bit of a waste of time, it would have been better to give him the full £20,000 fine made payable to the SSPCA/PDSA. So what if it took him years to pay it off, every payment would be a reminder of what he did, 6 weeks in jail(if that)is too lenient.

It was good that people were prepared to come forward and be witnesses. It is a pest when you keep getting different dates to appear but worth it when something actually happens. If more would come forward and stop saying 'Sno ma joab less would happen.

What happened to the dog?...I hope it was re-homed away from this piece of shoite...anyway...good result, could have done with a few more months, and a good kicking just to show him how it feels.

although two wrongs dont make a right, it is totally unacceptable for any human being to inflict harm on any animal. i am so glad that the folk who witnessed this disgusting vile piece of vermin, reported him to the authorities. althoug he only got a short sentence, i bet a pound to a pinch of sh*t, the coward has just been administered the best laxative the authorities could have administered. will he do it again....more chance of sh*t from a rocking horse, i say.

I READ WITH DISGUST AT WHAT SOME OF YOU WISH UPON MARTIN McNAUGHT.MAYBE ITS SOME OF YOU WHO NEED TO BE IN PRISON..MARTIN IS A VICTIM OF OVER EXAGERATIONS AND ROUGH JUSTICE .I WAS A WITNESS IN THIS CASE THE LIBEL AGAINST HIM WAS CHANGED AT THE END OF TRIAL TO HE PUT HIS FOOT ON SIMBAS HEAD AND SQAUSHED IT INTO THE PEBBLES GONE WAS THE STOMPING+STAMPING ON ITS HEAD OVER 20 TIMES..FOR A DOG NEAR KICKED TO DEATH SIMBA WAS PRETTY LIVELY WHEN I SAW HIM THAT AFTERNOON TWO TOP VETS TESTIFIED IN COURT ON OATH THAT SIMBAS INJURIES WOULD HAVE BEEN SEVERE HAD HE ENDURED THIS SO CALLED VICIOUS AND PROLONGED ATTACK.. NO INJURIES WHY?? BECAUSE IT DID NOT HAPPEN THE WAY MISS BREWSTER AND HER PARTNER SAY.. That's a non-sensical comparison. If someone had killed a human being with their car, that would be unintentional, unlike what this guy did to his dog.

What about David Waughman and all the other witnesses who came forward?

And why does it say in the article that Mr Mcnaught was with a child but no one else in the original article when you, the person who bought this dog, claim you were present.

And if what you say is correct, presumably you were a defence witness at the trial. And if so, you can reveal your full name because it will be on public record.

There is no escaping the fact that he lost his temper and took it out on a poor wee dog that wouldn't have harmed anyone.
What concerns me is - if this had been a small child, would he have done the same thing?

In my opinion, prison (or even a fine) is not the solution for him, because he will still have the violent tendancies within him.
I believe there is no cure for people, like McNaught, other than lobotomisation.
He needs to become docile, so that this can never happen again.

MY GRANDSON KENZIE WAS BUT HE WAS ONLY ONE YEAR OLD.AND HE WASNT ALL COVERED IN SICK WHEN HE WAS BROUGHT HOME..I WAS A PROSECUTION WITNESS AS IT WAS MY CAR MARTIN HAD,, AND IT WAS TAKEN FOR FORENSIC EXAMINATION THERE WAS NO BLOOD OR ANYTHING IN IT LIKE YOU WOULD EXPECT TO FIND IF A NEAR DEAD DOG WAS THROWN IN ITS BOOT AS THEY SAID ONLY THING IS HATCHBACKS DONT HAVE BOOTS ,,,PLEASE TO READ MY FIRST COMMENTS PROPERLY

Ahhh, so that's all that happened? What a big kerfuffle over nothing.

Somebody should really tell the SSPCA, the police, the Procurator Fiscal and the Sheriff that all the independent witnesses were somehow hallucinating when they seem him booting and stamping on the wee defenceless dog.

OK, I take some of your points. But the fact that it was changed to kicking the dog and squashing it's head into the pebbles doesn't really flatter your argument.

As for no evidence of blood, that means nothing. Serious injuries can be inflicted without spilling any blood at all.

And OK, 2 independent witnesses turned up in court but what about the quote from Doreen Graham from the SSPCA who said she was inundated with calls describing what happened and they were hard to listen to.

Try typing in lower case (you do know what that means I hope)and I might decide to read all of the drivel you write. Take your caps lock off and use your shift key when necessary.

I suppose you are the one who couldn't cope with some of our posts and had them removed. Mine had no religious or racial intolerance, did not contain any lies, swear words or libellous content. I can only think that you could have thought up some sort of lie to get my post deleted. We still have free speech in this country.

Finally, contrary to what you might think, giving a dog a kick up the a*se amounts to cruelty and I think I am correct in saying that most of us have not done that.
