Tesco's finest dishing out more £70 parking fines

MORE motorists have complained after being slapped with parking tickets by Tesco – including a pregnant mother who said she left her car in a disabled bay for a matter of minutes.
Following the Evening News story this week about a shopper who was hit with a £70 fine for parking outside a designated bay, other shoppers have reported similar experiences.

Katie Peart, 30, visited the Corstorphine store on the day of her three-
year-old's birthday so that his grandfather, who works in the supermarket, could wish the toddler a happy birthday.

But it turned out to be an expensive gesture when the pregnant mother-of-one returned to her car to find a ticket slapped on the windscreen last week.

She said: "I'm nearly five months pregnant now and there were no parent and child spaces, so I chose to park in one of the bays because I knew I'd only be a minute.

"As they've been rebuilding the car park, it is half its size and they have reduced the number of spaces for families. I didn't feel I had much choice but to park in the bay in my condition. We went in and said a quick hello to grandad and then came straight back out. I couldn't believe I had a ticket. It was a very expensive birthday treat and it muddied the day."

In an ironic twist, the parking bay Mrs Peart used has now been changed into a space suitable for parents and children.

Mrs Peart, a shop worker from Broomhouse, added: "I am gutted to have been hit with a £70 fine. That is my shopping bill for three weeks and we need every penny we can get."

Another Edinburgh resident, May Leckie, 61, contacted the Evening News to complain about her parking ticket after reading the case of bank worker Mark Robertson, who was fined £70 after parking outside a bay.

Ms Leckie, a nurse from East Craigs, said she parked in the same space as Mr Robertson for half an hour when she accompanied a friend who felt unwell into the store.

She said: "I was appalled to find the ticket. My car is only a tiny Peugeot and there is no way it was causing an obstruction, like the ticket said. I am appealing. Tesco parking is getting ridiculous."

A Tesco spokesman denied the number of child-friendly parking spaces had been reduced, and

added: "We're more than happy to re-check if someone feels they have been unfairly sent a reminder letter or fine. Customers need to ring the number on the letter.

"We know space is tight but improvements are being made.

"Clear signage does spell out we now operate a charge system for inappropriate parking or overstaying. We allow free parking in a city where this is a scarcity so we think all things considered this is a pretty fair trade-off."

When are all the bleaters that moan about they only parked in the disabled bay for a minute blah blah blah realise that they are in the wrong, morally and soon to be legally. I never have and never will park in one of these bays. Anyone who hasnt got a badge parked in a disabled space deserves everything they get!

Disabled bays are for disabled people, not pregnant people. Pregnancy is not a disability. It seems that everyone has an excuse as to why they can deliberately park outwith the guidelines.

Having said all that, #4 is spot on. Don't pay.

...But please start thinking.

There should be seperate bays for 4*4s and people carriers . It is crazy that I should have a job getting in to a space because small vehicles are badly parked .

#1 Absolute scum. Would like to see trash like you trying to get around in a wheel chair. Arriving at a supermarket to find the disabled bays full of abusive lazy slobs and then having to park in narrow bays. Then after struggling to get out into the wheelcahir having to go over pavements covered in dog turds and other keepsakes.
Being disbaled is a life sentence and having to put up with chavs like you makes things a hundred timnes worse.

About time they done same for the ones who take up two spaces because they can't or can't be bothered parking properly.

Yes, 4x4's and people carriers should have special parking as far away from the entrances as possible.

I didn't realise that a necessity for being a parking attendant in Tesco was that you should be psychic. How do these people expect the parking attendants to know their circumstances which lead them to park in disabled bays etc? If your car doesn't have a blue badge, it'll get ticketed. It's a simple concept. The parking attendant doesn't know the owner of the blue Ford Focus is pregnant and has just nipped in with her child to see the child's grandfather who works there to wish a happy birthday and she'll only be a minute. Use some common sense people!!!

If we're just going in for 20 minutes (a la Mark) or a minute, as per our woman here, then maybe parking attendents will accept notes left in our windscreens explaining what we're doing, and they'll not ticket us.

How many times do we have to say THESE ARE NOT FINES?!

If they were enforceable, then I could put a "No Jakeys, £100 fine" on my front door, and fine them when they come round selling door to door. If it's a fine, the police and the courts will enforce it. But I can't because it's NOT A FINE!

This doesn't excuse anyone parking in a disabled or family bay on private land that shouldn't - but that's a moral issue, not one that is subject to a fine.

Try this for a rebuttal letter.

"I refer to the above Parking Notice and subsequent warning letter demanding payment of a penalty charge. You state in your correspondence that terms and conditions were 'clearly and prominently displayed' on your client’s premises and therefore the inference is that by entering your client’s premises the driver of a vehicle has a legal obligation to abide by, and pay any charges incurred, under the terms and conditions.

As you may be aware, in Scots law, there is no such procedure whereby any privately owned Parking Control company may lawfully impose penalty charges upon any vehicle owner parked in private property, even where there is a contract in place between the owners of the property and your company. This may be standard practice in England but it is not in Scotland.

I have taken legal advice on this matter and I am advised that you have no statutory powers to issue penalty charges in Scotland. Your actions are unlawful and may be tantamount to extortion and theft. I refer you to Scots case law whereby:

‘In Scotland, wheel-clamping on private land is illegal. It was banned under a ruling in the sheriff court by the case of Black v Carmichael, 1992, SCCR 709, where a sheriff ruled that wheel-clamping was found to constitute criminal offences of extortion and theft.’

I am advised that Civil Penalty Charge procedures may be regarded in similar terms and as such, since there is no offence to enforce, you have no basis in law under which you have a right to take court action. You should also be advised that in your letter you warn that subsequent enforcement action would be carried out by Bailiffs. I should advise you that English Bailiffs have no legal authority in Scotland and any action taken by them would be regarded as a criminal offence.

This is not a Penalty Charge Notice as prescribed in law, even if it purports to be so. It is an invoice for alleged breach of accepted contractual terms or an offer to settle before court action for damages due to trespass.

If you persist in this matter, I will have no option but to report this to the police as threatening behaviour tantamount to extortion and theft.

If you intend to raise an action in court I am advised that I should obtain from you a copy of the agreement between yourselves and your client under which you have a legal right to impose parking charges, together with a copy of the appropriate legislation upon which you intend to found jurisdiction, in order that I may consult my solicitor in order to prepare a defence to any action. I should be grateful, therefore, if you would forward these to me as soon as possible."

Disabled bays should be done away with as theese sort of people can afford to pay for there parking, they want to be treated as able bodied, BUT they want all the perks that go with being disabled,ie, FREE cars, FREE parking, FREE road tax, FREE insurance, and to top it all a big massive GIRO every week, not to mention that shops have to adapt entry`s, without being to abrupt you are disabled, live with it, but dont come crying to us when someone parks in a parking bay with a wheelchair sign on it.

The big problem is that they have got away with parking were ever they wish up to now. Now they are complaining due to Tesco doing what they should have done years ago.

I go to the Corstorphine Tesco every week and there's no lack of space, just lots of lazy bassas.

Yesterday it was the chap who parked in the hatched area. Was this a parking space? No. Was the car then incorrectly parked? Yes. So why argue about it in a newspaper?

Today a pregnant woman parks in the disabled pay because all the parent and child bays were full. Was she disabled? No. Did she have a child in the back seat? No. Was the car then incorrectly parked? Yes.

Pair of inconsiderate, lazy, morons. God forbid you park a bit further away and walk.

That Tesco seems to be home for morons though as despite the sign that says shoppers turn right, works vehicles straight on you STILL get customers driving straight on.

Then there's the neds who park there in their mum's old Focus or Fiesta with their windows down chatting...is this their idea of a fun night out? "Awright pal, fancy drivin' doon tae Tesco and parkin' up fur a wee chat like?" "Aye, soonds pure braw pal." "We can discuss the radical differences between Magic Tree air freshener and Tesco own brand."

And the nurse, spot on she was probably meant to be taking her patient home and thought she'd sneek into tesco for a pie on NHS time.
Mark, the bank t*anker with the new BMW, see your redundancy has come through. That 70 quid must be a half tank of petrol for you.
It is disgusting that these cretins complain about a fine when they are able bodied and probably need the exercise.
