Man who had sex with 13 year-old girl was challenged by her mum

A MAN who had sex with a 13-year-old girl was confronted by the child's mother.
David Burns asked the victim to accompany him to a flat before taking off his trousers and asking her to have sex.

The High Court in Edinburgh heard that he did not use a condom but told her she better not be pregnant and not to tell anyone what h
appened.

But weeks later the victim arrived home drunk and upset and told her mother that she was frightened she might be pregnant because she had sex.

The mother took her to a doctor to make sure she was not expecting and later found out about Burns.

Advocate depute John Scullion said: "She went to his house and challenged him about what had occurred."

"Initially the accused denied having sex with the victim, but finally admitted that he had sexual intercourse with her," he said.

The prosecutor said: "The mother contacted the police a number of days later to report the matter because of her concerns about a 20-year-old man having sex with a 13-year-old girl."

Burns, now 21, was charged with raping the girl, but pleaded guilty to a reduced charge of having unlawful sexual intercourse with her in April last year at a flat in Westburn Grove, in Edinburgh.

Mr Scullion said Burns, who is currently remanded, had previously lived at the flat with a girlfriend and met the girl when was she walking in the street.

He said he was going to the flat to check for mail and asked her to accompany him.

Lord Kinclaven deferred sentence on Burns for the preparation of a background report and risk assessment.

The judge placed him on the sex offenders' register.
